The Ministry of Commerce Respond to WTO’s Announcement on Appealing to Chinese Rare Earth from America, EU, Japan

Nowadays, WTO has announced a report about America, EU, Japan appealing to Chinese export management of rare earth.

The leading official from the Ministry of Commerce of Treaty and Law Department has issued that the Appellate Body did not support American appeal, but stand by Chinese appeal on the basis of part terms of WTO’s rules, which was welcomed by China. China regretted to the adjudication made by the Appellate Body, which aimed to maintaining expert group’s compliance.

The leading official pointed out Chinese government has continued to strengthen and improve the integrated management to products with high pollution, high energy consumption and resource consumption in order to protect environment and non-renewable natural resource, which is also important to maintain global sustainable development. China believed that WTO do not only stress free trade, but also respect sovereignty of natural resources, and allow the members to protect resource by taking the necessary means. With the evaluation to WTO’s adjudication, China will strengthen the management of resource products, promote resource conservation, and maintain fair competition to achieve sustainable development in accordance with WTO’s regulation.

The officer said that the final adjudication will be defined when the reports from WTO’s Appellate Body and the export group are passed by WTO’s Dispute Settlement Body.
