China Implements Export Controls on Tungsten & Molybdenum Items

The Ministry of Commerce of the People's Republic of China and the General Administration of Customs have decided to implement export controls on tungsten, tellurium, bismuth, molybdenum, and indium-related items to safeguard national security and interests and fulfill international obligations such as non-proliferation. The relevant items subject to export control are as follows:

I. Tungsten-Related Items

(1) 1C117.d. Tungsten-Related Materials:

Ammonium Paratungstate (Customs HS Code for reference: 2841801000);

Tungsten Oxide (Customs HS Codes for reference: 2825901200, 2825901910, 2825901920);

Tungsten Carbide not controlled under 1C226 (Customs HS Code for reference: 2849902000).

(2) 1C117.c. Solid Tungsten with All the Following Characteristics:

Solid Tungsten (excluding granular and powdered forms) with any of the following characteristics:

a. Tungsten and tungsten alloys with a tungsten content of 97% or more by weight, not controlled under 1C226 or 1C241 (Customs HS Codes for reference: 8101940001, 8101991001, 8101999001);

b. Tungsten doped with copper with a tungsten content of 80% or more by weight (Customs HS Codes for reference: 8101940001, 8101991001, 8101999001);

c. Tungsten doped with silver with a tungsten content of 80% or more by weight and a silver content of 2% or more (Customs HS Codes for reference: 7106919001, 7106929001);

Capable of being machined into any of the following products:

a. Cylinders with a diameter of 120 mm or more and a length of 50 mm or more;

b. Tubing with an inner diameter of 65 mm or more, a wall thickness of 25 mm or more, and a length of 50 mm or more;

c. Blocks with dimensions of 120 mm × 120 mm × 50 mm or more.

(3) 1C004. Tungsten-Nickel-Iron Alloys (Customs HS Codes for reference: 8101940001, 8101991001, 8101999001) or Tungsten-Nickel-Copper Alloys (Customs HS Codes for reference: 8101940001, 8101991001, 8101999001) with all the following characteristics:

a. Density greater than 17.5 g/cm³;

b. Proof strength exceeding 800 MPa;

c. Ultimate tensile strength greater than 1270 MPa;

d. Elongation exceeding 8%.

(4) 1E004, 1E101.b. Technologies and information (including technical specifications, process parameters, and manufacturing procedures) for the production of items specified in 1C004, 1C117.c, and 1C117.d.

II. Tellurium-Related Items

(1) 6C002.a. Metallic Tellurium (Customs HS Code for reference: 2804500001).

(2) 6C002.b. Single-crystal or polycrystalline products (including substrates or epitaxial wafers) of any of the following tellurium compounds:

Cadmium Telluride (Customs HS Codes for reference: 2842902000, 3818009021);

Cadmium Zinc Telluride (Customs HS Codes for reference: 2842909025, 3818009021);

Mercury Cadmium Telluride (Customs HS Codes for reference: 2852100010, 3818009021).

(3) 6E002. Technologies and information (including technical specifications, process parameters, and manufacturing procedures) for the production of items specified in 6C002.

III. Bismuth-Related Items

(1) 6C001.a. Metallic bismuth and products thereof, not controlled under 1C229, including but not limited to forms such as ingots, blocks, beads, particles, powders, etc. (Customs HS Codes for reference: 8106101091, 8106101092, 8106101099, 8106109090, 8106901019, 8106901029, 8106901099, 8106909090).

(2) 6C001.b. Bismuth Germanate (Customs HS Code for reference: 2841900041).

(3) 6C001.c. Triphenylbismuth (Customs HS Code for reference: 2931900032).

(4) 6C001.d. Tris(ethoxyphenyl)bismuth (Customs HS Code for reference: 2931900032).

(5) 6E001. Technologies and information (including technical specifications, process parameters, and manufacturing procedures) for the production of items specified in 6C001.

IV. Molybdenum-Related Items

(1) 1C117.b. Molybdenum Powder: Molybdenum and alloy particles with a molybdenum content of 97% or more by weight and a particle size of 50×10-6m (50 μm) or less, used in the manufacture of missile components (Customs HS Code for reference: 8102100001).

(2) 1E101.b. Technologies and information (including technical specifications, process parameters, and manufacturing procedures) for the production of items specified in 1C117.b.

V. Indium-Related Items

(1) 3C004.a. Indium Phosphide (Customs HS Code for reference: 2853904051).

(2) 3C004.b. Trimethylindium (Customs HS Code for reference: 2931900032).

(3) 3C004.c. Triethylindium (Customs HS Code for reference: 2931900032).

(4) 3E004. Technologies and information (including technical specifications, process parameters, and manufacturing procedures) for the production of items specified in 3C004.

Export operators exporting the aforementioned items shall apply for a license from the competent commercial department of the State Council in accordance with the relevant provisions of the Export Control Law of the People's Republic of China and the Regulations on the Export Control of Dual-Use Items of the People's Republic of China.

This announcement shall be officially implemented from the date of its issuance. The Export Control List of Dual-Use Items of the People's Republic of China shall be updated accordingly.
