Include Rare Earth, China Announces Second Round of Tariff Exclusions for US Goods

Including rare earth, gold mines, and medical disinfectants, the State Council Tariff Commission of China announces the Second Exemption list of tariffs on the US and Canada goods.

According to the Announcement of the Customs Tariff Commission of the State Council on the Trial Implementation of the Exclusion of Tariff Commodities from the United States (Tariff Commission Announcement [2019] No. 2), with the approval of the State Council, the Customs Tariff Commission of the State Council announced the second batch of tariff commodities imposed on the United States including rare earth, gold mines, and medical disinfectants.

The second exclusion list of China on the US commodities, for the second batch of goods subject to tariffs imposed on the United States, and the second exclusion of some of the products, from May 19, 2020, to May 18, 2021, no longer levy add to the anti-US 301 measures levied tariffs.

The first batch of commodities, from February 28, 2020, to February 27, 2021 (one year), the tariffs imposed as countermeasures against the US 301 measures will no longer be levied. The customs duties and taxes that have been levied shall be refunded, and the relevant import enterprises shall apply to the customs for processing within 6 months from the date of publication of the exclusion list.

The second batch of remaining commodities, from February 28, 2020, to February 27, 2021 (one year), the tariffs imposed as countermeasures against the US 301 measures will no longer be levied. Duties collected have not been refunded. The Customs Tariff Commission of the State Council will continue to exclude tariffs on the United States, and publish a subsequent batch of exclusion lists in due course.

The Second Exemption list of tariffs of China on the US and Canada goods include rare earth and medical disinfectants. For the products that are not included in the first and second batch of products subject to tariff exemption from the United States, enterprises may follow the “Announcement of the State Council’s Tariff Commission on Carrying out the Market-based Procurement and Exclusion of Products Subject to Customs Addition to the United States” (Tax Commission Announcement [2020] No. 2), apply for market-based procurement exclusion.
